Information On New Ct Laws Regarding  Common Interest Ownership Act

 

Heads up, you better not ignore these changes, there are sweeping changes which according to some are the most comprehensive overhaul of laws which govern condominiums in over 25 years.

 

To those who do not know about the CT Common Interest Ownership Act better get with it. It is known as CGS 47-200 / 47-295 and below is a link to the Conn. Government web site:

In short the reversions are listed as P.A. 09-225 -  S.H.B. 6672

An act concerning amendments to the uniform common interest ownership act.

“This act passed and shall take effect as follows:  Sections 1-14, and 16-19 and 21-43 shall take effect July 1, 2010; Section 44 shall take effect upon passage, which is the day the Governor signed the bill and Sections 15 and 20 shall take effect upon passage and applicable to common interest communities created before, on or after January 1, 1984.   The Governor signed the bill on July 8, 2009. 

Note above, “created before, on or after January 1, 1984” these laws will apply to every condominium, cooperative, and planned community in the state, regardless of when it was created, beginning July 1, 2010. 

In an article by Adam J. Cohen, Esq. in the “Common Interest” magazine Vol. IV, Issue 6, 2009 pages 10-13 and page 27, he outlined brief reviews of some of the changes. Among them, recordkeeping, resale certificates, the way meetings are held, enforcement actions, modernization, voting procedures, governing documents, declarant relations, and budgets and assessments. These are only a few of the changes.

Kim McClain, CAI-CT Chapter Executive Director stated in the same issue, “The bottom-line: it is imperative that your association understands these changes and the affect they will have on how your association conducts business. By the time you read this, you will have about 10 months to comply with the provisions of 09-225.”
